Nexira Studios (the "Studio", "we", "us", or "our") is a creative studio built on original work, and we respect the intellectual property rights of others just as we protect our own. This Copyright and DMCA Policy explains how to notify us of alleged copyright infringement on this website, how we respond to such notices, and how a counter-notification can be submitted. This Policy is intended to be consistent with the Digital Millennium Copyright Act, Section 512 of Title 17 of the United States Code (the "DMCA"), and should be read together with our Terms of Service and Intellectual Property Policy, available on this website.

1. Scope of This Policy

This Policy applies to content displayed on this website, including images, texts, and design materials, as well as to materials submitted to the Studio by clients in the course of commissions. It describes the procedure for copyright owners and their authorized agents to report alleged infringement and the procedure for affected parties to respond.

2. Reporting Copyright Infringement

If you believe that material on this website infringes a copyright you own or are authorized to enforce, please send us a written notice containing the following: your physical or electronic signature, or that of a person authorized to act on behalf of the copyright owner; identification of the copyrighted work you claim has been infringed, or, if multiple works are covered by a single notice, a representative list of those works; identification of the material you claim is infringing, together with information reasonably sufficient to allow us to locate it on this website, such as a description of the page on which it appears; your name, postal address, telephone number, and email address; a statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf. Notices should be submitted in English where possible.

3. Where to Send Notices

Notices of alleged infringement and counter-notifications should be addressed to the Studio's designated Copyright Agent using the contact details listed at the end of this Policy, with the subject line "DMCA Notice" or "DMCA Counter-Notification" respectively. Please note that these contact details are intended for intellectual property matters described in this Policy; general inquiries should be sent through our Contact Us page.

4. Our Response to Valid Notices

Upon receipt of a notice that substantially complies with the requirements above, the Studio will review it promptly and in good faith. Where appropriate, we will remove or disable access to the material identified in the notice, take reasonable steps to notify the party responsible for the material where that party is known to us, and document the notice for our records. The Studio may request additional information where a notice is incomplete or unclear. Submitting a notice does not require you to be a client of the Studio.

5. Counter-Notification

If material you posted or supplied has been removed or disabled as a result of a notice and you believe this was the result of a mistake or misidentification, you may send us a written counter-notification containing: your physical or electronic signature; identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled; a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification; and your name, postal address, and telephone number, together with a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside the United States, of any judicial district in which the Studio may be found, and that you will accept service of process from the person who provided the original notice or that person's agent.

6. Restoration of Material

Upon receipt of a valid counter-notification, the Studio will forward it to the party that submitted the original notice. Unless that party informs us within ten (10) business days that it has filed an action seeking a court order to restrain the allegedly infringing activity, the removed material may be restored, or access to it re-enabled, within ten (10) to fourteen (14) business days after receipt of the counter-notification, at the Studio's discretion and in accordance with applicable law.

7. Misrepresentations

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees, incurred by the alleged infringer, by the copyright owner or its licensee, or by the service provider. Do not submit false claims.

8. Repeat Infringers

The Studio reserves the right, in appropriate circumstances and at its sole discretion, to refuse service to, terminate commissions with, and cease collaboration with any person or entity that is determined to be a repeat infringer of copyrights or other intellectual property rights.

9. The Studio's Own Copyrights

All original artwork, illustration, design work, and website content created by the Studio is protected by copyright from the moment of creation. Unauthorized reproduction, distribution, public display, or creation of derivative works from the Studio's work, beyond the scope of a granted license, is prohibited, and the Studio actively enforces its rights and the rights of its clients. If you wish to license, reproduce, or otherwise use work created by the Studio, please request permission in writing using the contact details below before any use is made.

10. Public Domain Works

Certain historical paintings reproduced on this website for decorative and illustrative purposes are works in the public domain. The Studio claims no copyright in those underlying historical works. The original design, arrangement, and accompanying content of the pages on which they appear remain protected as described in our Intellectual Property Policy.

11. Not Legal Advice

The information in this Policy is provided for convenience and does not constitute legal advice.
